Mumbai: Maintaining that the constitution is greater than the assessment of the court, NCP President Sharad Pawar on Monday asked the center to enact the law to eliminate the limit of the Supreme Court of 50 percent on the reservation and allow the state to exceed the existing quota limit.
Overcoming a press conference here, pawar asked the mod to bring the constitutional amendment to relax 50 percent stamp on reservations in work and education and allow the state to exceed the existing quota limit.
Article 15 (4) and 16 (4) (dealing with the provisions for social and educational reverse classes, and reservations) do not put any limits on the percentage of quota and no constitutional obstacles in increasing the same, the former Union minister said.
The central government has exceeded a 50 percent limit by providing a quota of 10 percent in work and education for the economically weaker part, said pawar.
Pawar asked the center to conduct a caste-based census and claim the mode central government misleading people on quota problems.
“The constitutional amendment to restore the rights of the countries to prepare the OBC list, taken away two years ago, is a mere eyewash,” he said.
“Unless the hat is 50 percent relaxed, the maratha quota cannot be restored.
Similarly, empirical data on OBC must be shared with the state.
Unless the data is available, it cannot be seen how much representation needs to be given to smaller caste,” the leader said NCP.
Pawar said the reservation was in most states above 60 percent.
“Someone must show the courage to speak in front of Modi.
Fraud is the only motive for the amendment of the Constitution,” he said.
On August 10, Lok Sabha issued a bill that allowed the state to decide who their other back class (OBC).
The Constitutional Amendment Act 127th, 2021, restored the power of the state to identify social and educational reverse classes (SEBCS), usually called OBC.
In May, the Supreme Court crashed into the 2018 Maharashtra quota that gave a quota to Maratha in the acceptance and work of the government, called it “unconstitutional”, and held there was no extraordinary state to violate the 50 percent reservation stamp determined by the 1992 mandal verdict.
