Reinstate 41 AI pilots, Return Salaries into These: Delhi HC

NEW DELHI: The Delhi high court on Tuesday came from the rescue of 41 Air India (AI) pilots that were sacked from the company this past year, since it quashed the nationwide carrier’s determination and led his reinstatement.

The pilots claimed there was a deficiency of decision-making from AI if they withdrew their resignations which was filed in 2019.
Citing the Civil Aviation Requirements (CAR) issued by the DGCA, the pilots had been needed to serve a compulsory six weeks’ notice period where they withdrew their resignations at March 2020, Sehgal submitted.
But no decision had been taken by AI about the withdrawal of those resignations, forcing them to proceed to the HC.
Even since the statute was AI issued a letter on August 13, 2020 illegally and retrospectively accepting their resignation, ” the request claimed, in breach of settled place of lawenforcement.
In November this past year, the HC had requested AI to have a sympathetic view of this situation and stated the employees cannot be left high and dry.
Defending its conclusion, AI had told the courtroom that following lockdown, 90 percent of its routine pilots are still sitting at home as many of its fleet was cited enormous reductions of Rs 1,300 crore every month.
It stated that taking that the withdrawal of resignations can lead to financial distress, especially in light of Covid-19 when claiming that contractual duties can not be contested in writ petitions.
The large courthad requested Air India to look at the grievances of these pilots, who were engaged on contract when they superannuated.
It’d requested AI to check if there’s a chance of a”golden handshake” to them.
