Nagpur: A professor of Nagpur University has transferred the Nagpur bench of the High Court demanding the elimination of Chancellor Chancellor Chaudhari who accused the systematic victimization and abuse of power by Him, below section 11 (14) (e) Maharashtra Public University Law, 2016.
Professor Mohan Kashikar, former Head of the Department of Political Science, approached the judiciary after VC replaced him with Professor of Professor Shyam Coretti on July 31, while picking up allegations of unclear professional violations and an investigation of the department (DE) against him.
Just a probe, a division bench consisting of Judge Sunil Shukre and the Anil KiTor justice issued a notice for the final disposal to Chancellor Bhagat Singh Koshyari, Nu Raju Hwase Registrar, Coretti and VC.
“The costs are so blurred so they don’t show certain errors.
In addition, the respondent does not make the applicant be informed adequately to allow him to prepare his defense.
We found that at least DE, which is continued based on an unclear load sheet, cannot be permitted to continue up to resume Continue, “said the judges.
While directing Coretti not to take part in any process associated with his new post, the judges said since the 31st order of July only gave him a temporary charge, the problem in this case could be kept open and considered only after a detailed reply from the respondent.
After posting hearing until next week, the bench directed the HC registry to the Kashikar club petition with the previous case (WP No.
1974/2000) opposed the applicant’s actions to impose two sentences on the same demands and removal of the post.
The Petitioner, despite the advisor of Firdos Mirza, argued that the accusation of him did not see a violation case and he was not told correctly about the material to be placed in De.
“There is no professor of other disciplines or those from the historical department that can be appointed as HOD to replace Kashikar.
The appointment of Coretti violated HC’s view in the first petition of the Petitioner,” Mirza argued.
The applicant was twice as HOD in 2007 and 2016 and was chosen to post VC at the State University of Dr.
Homi Bhabha in Mumbai last year.
NU even issued a certificate did not mind (NOC) stating that the integrity was undoubtedly.
Before that, he was appointed as officers responsible for the Postgraduate Teaching Department (PGTD) Humanities on September 9, 2020, by VC.
Because he was involved in academic and teaching responsibilities, Kashikar rejected the position.
Irked for his rejection, Chaudhari issued a notification on September 23 which was looking for an explanation of why disciplinary actions should not begin.
When Kashikar looked for further details from the registrant, he received another notification that he intentionally did not reply and thus commit a violation.
Kashikar then submits a detailed reply that explains that new posts are internal settings for building maintenance, and it is not included in the task of a teacher.
However, he applied with two punishment and was excluded from the position forced him to submit the first case in HC.
While the NU 16 June order, HC had asked Kashikar to submit a representation to VC to be reconsidered.
However, the order of his restoration was issued on July 25, five days before the settlement of his five-year term as HOD.
VC issued another notification to Kashikar claiming that he was found absent from the department for many visits and also failed to do college.
Despite submitting a detailed reply to notice, Coretti was appointed in his post on July 31 which violated Law 55, Kashikar said.
