Jaipur: Litigation Public Interest (PIL) has been submitted by Jodhpur based in Saarthi Trust which manages Trustee Kriti Bharti in Rajasthan High Court, challenging the constitutional validity of Rajasthan Mandatory Marriage Registration (Amendment), 2021 which has the provisions of the registration of children’s marriage in the state.
The applicant said that through this amendment, the government has tried to provide a registered recognition to the child’s marriage malpractice which is a violation that can be punished.
Apart from this, a petition has also begun on social media on amendments that have collected more than 6,000 users.
Rajaslative Assembly Rajasthan on September 17 passed the Ruga Ruga (Amendment) of Rajasthan, 2021.
In this amendment bill, the government has made provisions for registration of a marriage to a girl under 18 years and a marriage of a boy under 21 years in one month.
Bharti, who has canceled the marriage of children and has stopped more than 1,500 children’s marriages so far, said, “The future consequences of providing registered recognition to children’s marriage will be quite fatal.
To get a marriage certificate for a Government Child, people will come to Rajasthan during A month and will throw away their children to child marriage.
Because of Rajasthan, which has been famous for years because it has the highest prevalence of marriage children in the world, will turn into a child’s marriage hub with this amendment.
“In the pill that the Rajasthan government was also wrong Interpreting the 15-year-old Supreme Court assessment as an excuse to give Rajasthan Mandatory Rugestan Bill (amendment).
“The Rajasthan government also has not fully followed the orders of the Supreme Court given in the assessment”, added Bharti.
However, the Rajasthan State Commission for the protection of children’s rights (RSCPCR) has claimed that the proposed law does not encourage child marriages but protect government benefits and legal rights.
This is a response to the National Child Commission for the protection of children’s rights’ claims that the proposed amendment legitimates children’s marriage.
The State Commission said that a misunderstanding was spreading regarding the bill and that the 2006 anniversary of the child’s marriage was only able to be amended only by the central government.
