A Mumbai civil court has ordered temporary restraints on access to online mobile games titled ‘Selmon Bhoi’, allegedly based on a hit-and-run incident involving Bollywood actor Salman Khan.
The civil court judge K M Jaiswal passed the order on Monday and the copy was made available on Tuesday.
Court detained the game maker, Parody Studios Pvt Ltd and his director, from distributing, launching, launching back and recreating other games or content related to actors.
The court also directs the makers to immediately take / block / deactivate access to the game from the Google Play Store and all other platforms.
“After watching the match and the picture, it was prime facie fits the identity of the Plaintiff (Khan) and to the Hit-and-Run case connected to the Plaintiff,” said the court.
Furthermore, said Khan never gave his approval for the game.
“When the Plaintiff has not given his approval to develop the game, which is very similar to his identity and his case against him, of course his right to privacy is being seized and his image is also tarnished,” said the command.
The court added that game developers used Khan’s identity and popularity for commercial benefits.
Khan has submitted an application in the court last month against the game developer, claiming that the name and image displayed in this game seem to be the caricature version.
The application claims that the ‘Selmon Bhoi’ game is phonetically the same as the popular name of Khan among his fans, ‘Salman Bhai’.
“Game developers deliberately obtain commercial benefits by exploiting the personality rights of our clients without seeking our client’s approval,” said the actor application submitted through legal DSK law firms.
The court directed the developer to submit a statement of their statement to Plea Khan and recorded this problem to hear further on September 20.
The Bombay High Court in 2015 was released by Khan from all charges in the case of HIT-AND-RUN 2002.
