In a setback for the Kerala government, the Supreme Court on Monday refused to entertain his request to extend the time to complete the trial in the case of rape actors, involving Malayalam Dileep actors, who were allegedly accused of being the main conspirator of crime.
Bench consisting of judge.m.
Khanwilkar and C.T.
Ravikumar said such requests could only be made by the trial judge and the judge could also submit a report before the upper court who was looking for extensions if felt necessary.
Senior Advocate Jaideep Gupta, which represents the Kerala Government, is looking for more than 6 months, because the time limit to complete the trial is February 16.
However, the bench was clear that it would not provide extensions, in the example of the Kerala government.
Senior advocate beat Rohatgi, appearing for Dileep, opposing the government’s request and proposed that the state government tried to postpone the trial.
He loudly argued that the time to complete the trial had been extended several times.
He argued that after the 200 witness examination, another man came with a series of new charges when the trial in this case would complete.
The bench that verbally observes that it will not pass orders on the state government instances and dispose of the application.
“We left him at the wisdom of the court trial to take the right view in this matter …”.
Rohatgi shows all extensions in the trial on request made by the judge session and not by one of the parties.
He added that the state government was not justified in finding extra time and for the judge concerned to find extra time if he thought it was needed.
At the end of hearing, Gupta urged the upper court to maintain the application of the state government delayed, which was opposed by Rohatgi.
The bench noted that if it continued to be delayed, then it would give a different meaning.
Rohatgi said the state government was conducting media trials on his clients.
Dileep was allegedly accused of hatching a criminal conspiracy in connection with the abduction and sexual attack of the victim, in a vehicle engaged in the outskirts of Cochin in February 2017.
