New Delhi: The Supreme Court while rejecting the request to challenge the national court order to impose a complete ban on the sale and use of all firecrackers during the Covid-19 pandemic in cities, saying that there is no further clarification or deliberation.
Justice of Justice Am Khanwilkar and Justice Sanjiv Khanna said that NGT in the order had decided on problems and no further clarification or deliberation needed.
Furthermore said that the authorities could allow the sale and use of firecrackers according to the category of air quality index (AQI) in cities.
The bench said that manufacturing or firecrackers are permitted and those who want to use firecrackers can do it with permission depending on the AQI category.
It clarifies that a ban is in places where air quality is bad and there is no prohibition of making.
“Tires are the only category of Defendants in the air.
When there is poor air quality, all activities must stop”, observe the bench.
The Apex Court heard the appeal of firecrackers and dealers who challenge the NGT sequence where he prohibits the sale and use of firecrackers in Delhi-NCR and other cities in India, where AQI is bad.
During the trial, advocate Sai Deepak J appeared for firecrackers, argues that firecrackers do not appear at the Indian Technology Institute for 15 reasons for pollution.
The bench, however, observed that scientific studies were not needed to measure the adverse effects of firecrackers on people’s health.
“Do you need to understand that firecrackers affect your health? Ask someone to live in Delhi what happened during Diwali,” said Khandelwal justice.
Furthermore, directing that district judges have been directed to ensure that firecrackers that have been forbidden will not be sold, and are authorized to restore compensation in cases of violations.
