SC Nixes Maharashtra Request Junk CBI FIR against Anil Deshmukh

NEW DELHI: The Supreme Court on Wednesday rejected the Maharashtra government’s request and former Minister of Home Anil Deshmukh for trying to cancel the FIR who invited him with the CBI in a corruption case, including the previous government’s approval was not yet taken.
After hearing everyday, the judicial bench D Y Chandrachud and M R Shah said they did not need to disturb the verdict of the Bombay High Court who rejected the request.
Advocates Rahul Chitnis, emerged for the Maharashtra government, said the direction of the High Court was for limited investigations on charges of collecting money from bars and restaurants and not on transfers, posting police officers as mentioned in cases registered by the CBI.
However, the bench, said once the probe was ordered, the agency would look into all aspects that arose during the investigation.
It is said that the state must be approved for a comprehensive investigation to determine the truth and observe that the state is trying to “massage” the probe at each stage.
It refused the request against July 22.
The order of Bombay HC and said it could not weaken the direction of the Constitutional Court which ordered the CBI investigation by drawing lines for institutions that had been carried out by the investigation.
Bench after hearing the petition was submitted by Deshmukh against the same HC verdict.
Senior advocate Amit Desai, made a comprehensive argument about part 17A prevention of corruption law (amendments), 2018 where sanctions are needed to demand public officers.
He said it was obliged to get approval from the state government that was not carried out and looked for court interference because this problem had not been handled by the court after the amendment was brought in 2018.
The bench, said it was not tended to interfere and it would pass a detailed order if the Applicant wanted .
