New Delhi: The Supreme Court on Friday refused to keep the National Law School of India (NLSII), Bengaluru, to order 25% of seats for students from Karnataka.
Judge L Nageswara Rao and Ravindra Bhat rejected Nlsiu’s notice that introduced a 25% horizontal quota for students who domiciled by Karnataka who were looking for BA, LLB (Hons) and the LLM program offered by the University.
The University Government Agency has argued that it is part of the “University expansion and expansion plan 2021-24”.
Those who have studied at the Karnataka Education Institute for at least 10 years are eligible to enter below the quota.
After his decision, Nlsiu asked Karnataka students to update the 2021 General Test Application Form to utilize this quota.
Request for a temporary stay was carried out while the APEX court heard the appeal submitted by the Karnataka government which challenged 2020 assessment of the Karnataka High Court which inhibited laws passed by the State Assembly to provide students who domiciled 25%.
It was said that the revised revenue notification was an attempt to forget the assessment of the Karnataka High Court.
But the state government opposed the application and argued that the High Court attacked the amendment of laws on the grounds that the legislature did not have the competence for intro-duce reservations in NLSII.
It was said that there was nothing wrong in the current reservation system because HC judgment also acknowledged the power of the NLSIU Executive Board to introduce this reservation and reservation was introduced by NLSII in terms of strength recognized by the High Court.
