New Delhi: The Supreme Court on Tuesday rejected the request to find clues to the center and others to pay Rs 50 lakh ex-Gratia to relatives of advocates who had died within 60 years both because of Covid-19 or other reasons, said the lives of lawyers could not It is said to be “more valuable” than others.
Observing that it cannot encourage the submission of “bogus” litigation of public interests (pills) by lawyers, the bench headed by Justice D Y Chandrachud said the application was “Flower Litigation Publicity” and not a relevant place in it.
The bench also consisted of Judge Vikram Nath and BV Nagarathna, said some people had died of Covid-19 in the country and there were judgments that were passed by the APEX court which dealt with framing compensation guidelines to relatives had died as a result of the Coronavirus.
“Do other people from the people who are not important,” Bench told Advocate Pradeep Kumar Yadav, who had submitted a petition.
“This is a litigation of interest in publicity and only because you are in a black coat does not mean your life is more valuable than others,” the bench was observed, adding, “We should not encourage a lawyer to apply for pills.” The upper court, which observed that “Cut-Copy-Paste” was carried out in the application, said it would not happen that lawyers would apply pills like this to demand compensation and the court will allow it.
It was said that some people had died because Covid-19 and lawyers could not be an exception.
Yadav asked for a bench that he would take a request and submit it for a better reason.
The bench, however, rejected the petition at the cost of Rs 10,000 paid to the Supreme Court Bar Association within a week.
In his request, Yadav had sorced the center, the Indian Council Bar and several other bodies as respondents.
The petition has been looking for directions to respondents to pay the ex-gratia Rs 50 Lakh to relatives of advocates, who have died within 60 years both from Covid-19 or other ways, and in the case of pandemic, additional monetary assistance provided to them.
