SC requested the status to submit a status report on vacancies, Pendency cases in the Information Commission

New Delhi: The Supreme Court on Wednesday directed the countries to submit a status report to provide details of the number of vacancies and delayed the application in the State Information Commission (SIC) under the Right to Information Act (RTI).
Judge S Bangku Abdul Nazeer and Krishna Murari on July 7 have been looking for reports from the center and countries about compliance with the verdict of 2019 who asked them to ensure charging the information commissioner in CIC and the state under the legal transparency.
In an important verdict in the law of transparency, the APEX court has come out with many directions on February 15, 2019 and ordered that the selection process to fill vacancies in the Central Information Commission (CIC) and the State Information Commission (SIC) must begin two months before they rise and the search committee Must choose people from various fields and not limited to bureaucrats.
Previously, the court had noted that the final status report at the center of Compliance was submitted more than a year ago and asked the additional lawyer General Madhvi Divan to submit a new status, the steps taken to fill it and associate other directions.
“Respondents, Indian Unity and Countries, are directed at submitting the latest status and compliance reports within four weeks since today.
Register after four weeks …
Petitioner (Activist RTI Anjali Bhadwaj) is also allowed to submit additional affidavit while,” The bench said in its order.
The above court heard a request for RTI activists who seek the implementation of the 2019 verdict on appointments to CIC and SIC under ACT.
Bhardwaj is also looking for directions for government authorities about the implementation of the command of the upper Court asking them to appoint information commissioners.
Bhushan said an application has been submitted to fill vacancies in CIC and SICS.
“Directions are given in 2020 that these posts need to be well stocked in time.
Other important directions are issued.
The court has suspended the practice of only choosing bureaucrats or having a selection committee only from bureaucrats,” he said.
He has said there are vacancies in SICs in countries such as Maharashtra, Odisha, Karnataka and West Bengal and there is a need to implement the direction of this whole court.
He alleged that around 75,000 and 36,000 cases under RTI were waiting for adjudication in Maharashtra Sic and CIC respectively and efforts had been made to make RTI legislation ineffective.
The APEX court, in 2019, said the selection of information officers for CIC and SIC must include people from various fields and not limited to bureaucrats, “bias” that “writes great” in the current selection process.
Parliament is said to be the intended by people from the public life considered as CIC as well as ICS but a “Trange phenomenon is happening”, that people who have been chosen only belong to one category which is a public service.
It also said that to bring transparency in ICS selection, countries must adopt the central process where it uploaded on the website of the search committe names, the names of candidates who have been selected for selection.
The top court then direct the center and eight states – West Bengal, Odisha, Maharashtra, Gujarat, Nagaland, Andhra Pradesh, Kerala and Karnataka – to fill vacancies without delay within one to six months.
