New Delhi: The Supreme Court on Wednesday booked an order on the request of 12 BJP MLAS challenging the decision of the Maharashtra Assembly to suspend them for one year for allegedly behaving badly with the main officer.
Ending hearing, the judicial bench am Khanwilkar, Dinesh Maheshwari and CT Ravikumar gave a one-week party to submit their written submission.
During hearing, the disadvantaged MLA was conveyed that a prolonged suspension was worse than expulsion and it was also a punishment for the electoral district which would remain not realized at home for a long time.
One year suspension is very irrational, arbitrary and illegal, they accuse.
On December 14 last year, the Supreme Court had searched for responses from the Maharashtra legislature and the state government in the application submitted by MLA who challenged the resolution by home to suspend them for one year.
MLA is Sanjay Kute, Ashish Shelar, Abhimanyu Pawar, Girish Mahajan, Atul Bhatkhalkar, Parag Alavani, Harish Pimpale, Yogesh Sagar, Jay Kumar Rawat, Narayan Kuche, Ram Satty and Bunty Bhangdia.
The bench further observes that suspension outside the six months may oppose constitutional provisions and prolonged suspension will be opposed to democracy.
