The Apex Court heard the batch of challenging center petition and on 29 July notification of a 27 percent reservation for OBC and 10 percent for the EWS category in the NEET medical program
In his written statement, the center has justified his decision to set the annual income limit of Rs 8 Lakh remains to determine the EWS category for reservations at NEET’s medical reception.
Affidavit submitted by the Ministry of Justice and Social Empowerment says that the principle of improving the number is rational and in accordance with Articles 14, 15, and 16 constitutions.
It is said that the exercises made to determine the cream layer for OBC reservation will be the same as determining the EWS category because the fundamental premise is that if someone / family has a substantial economic position, he may not need the benefits of reservation at the cost of others.
Major Gen (Retd) Commission Sin Sinho was formed by the Government of UPA in 2010 and recommended the steps of welfare for the EWS category.
The Ministry further said that the criteria for determining the EWS category was lowered after deliberation because all stakeholders were related.
The center said that even before the office memorandum on January 17, 2019, it was in the context of identifying the economical reverse class (EBC), the government had established the Commission General Sinho Major in 2005.
It is said that this commission has a report in July 2010, arriving in various conclusions including the criteria for identifying ‘cream layers’ among OBC can function as a basis for deciding the upper limit or as the criteria identify the EBC family among the General Categories as well.
The ministry proposed that the determination of the EWS category in terms of office memorandum dated January 17, 2019, was not too inclusive and did not need to be disturbed.
On October 21, the top of the court has asked the center whether it wants to review the Lakh annual Rupee limit to determine the EWS category for reservations in medical courses.
The top yesterday has clarified that it did not start a policy domain but only tried to ascertain whether constitutional principles were inherent or not.
