Chennai: The school that refused to issue a transfer certificate (TC) to students who quoted unpaid costs or other reasons to face the insults of the court, said Madras High Court.
Justice N Anand Venkates has explained that schools must independently exercise for such problems in a way that is known to the law, but the same thing will never be an excuse to deny the issuance of TC.
“Students / parents must have absolute freedom to make decisions about the continuation of education in existing schools or to get transfers to other schools anywhere.
If there are students who apply to TC, the same thing must be issued in one week from the date of receipt of the application, “Judge said.
If there are schools that refuse to issue TC, a complaint can be done to the chief educational officer (CEO) concerned and the action must be taken for violations of this order.
It must be ensured that TC was issued for students.
If there is such a violation taken to this court notice, this court will also begin the process of insulting Suo Motu to the school concerned to violate the instructions issued by this court, the jury added.
Justice Anand Venkatesh also explained that the instructions were issued by considering the situation of the pandemic and when and when the normal state was restored, the enactment and regulations would take care of the transfer of students from one school to school.
The court also directed the commissioner of school education to issue circular in this case with all schools within two weeks.
The court passed the order on the request transferred by the District Financing School Association, represented by President S Prince Babu Rajendran.
The association wants a court to hold the school education department from allowing schools in recognizing students without transferring certificates from members of the Applicant Association where students previously learned.
