Chennai: Dig-rank officers who were suspended, Rajesh Das, who faced the trial in connection with the case of sexual harassment submitted against him by a female IPS officer, had moved Chennai’s bench about the middle tribunal (cat) challenging his suspension.
Recognizing his request on Tuesday, Judicial members D Mahra had directed the Tamil Nadu government to respond to his request on December 20.
The court has also directed the state government to ensure that subsistence benefits are given to officers.
Claiming that the suspension was ordered based on observations carried out by a single judge in the High Court, Rajesh Das said the suspension and extension had been made without the application of the mind.
Therefore, he wants the court to override suspension and direct the country to restore it in service with all the benefits of officers, including seniority.
Rajesh Das argues that the trial of the Internal Complaints Committee (ICC), and the demands on April 8 are wrong and wrong because they do not follow the principles of natural justice.
“Memo accusations dated May 31 issued on that basis, therefore, illegal and contrary to the rules.
There is no independent application in mind by the disciplinary authority,” he added.
He argued that the Supreme Court and the High Court had held several examples that did not provide opportunities for representatives to parties to defend them effectively during the investigation and did not provide a copy of the investigation report to weaken the process.
Although the ICC report was submitted on April 8 and the Department further process has also begun based on the same thing, until now, the report has not been presented to the Petitioner and therefore all trials can be hit, he added.
