Mumbai: A report that recommends increasing the number of punishment for several violations based on the Shakti law proposed by the 21-member Joint Election Committee under the Second Ministerial Minister submitted on RedNesday on Wednesday.
The revised bill for laws on women’s crime will be moved in this session itself.
The bill, was modeled to the Disha law in Andhra Pradesh, was first submitted in the legislature in December 2020.
The government referred to the committee, held by 13 meetings before sending its recommendations.
It has recommended an increase in the number of punishment for cases of acid attack under the 326A IPC section to at least 15 years that can extend to the remaining natural life of prisoners, and fine to be paid to victims (see boxes).
“Expenditures of plastic surgery and facial reconstruction operations for victims will be taken care of from the monetary fines to be charged to the defendant,” Minister of Home Dilip Walse Patil to the house.
The panel has also increased the punishment under the IPC EW part 175A for failure to share data for probes by social media platforms, internet providers (see boxes).
Also, under ACT Pocso, data must be three days with a punishment.
Punishment will be increased for false complaints and to provide wrong information to public servants.
“The provisions below the bill are made more stringent to punish the cause and regulate prevention.
However, it is also necessary that innocently be saved and very severe punishment is needed against people who submit false or wrong complaints,” the report said.
Under section 354E, which provides punishment of actions that intimidate women by means of any communication and insulting its politeness, the category of perpetrators has increased to cover men, women and even transgender people.
The Draf of the bill provides a death penalty for crimes against women and children, and as part of a revision, the police have been given 30 days to complete violations such as rape and acid.
30 more days can be given after determining the reason by special IG or police commissioner.
The committee has also canceled the provisions not to provide anticipatory guarantees to people who make complaints wrong or wrong.
The original bill does not provide provisions to find anticipatory bills in such cases.
