Mumbai: Bombay High Court on Thursday rejected an application submitted by actor Kangana Ranaut to cancel the criminal defamation process initiated by Metropolitan Judge Andheri against him in February on the complaint submitted by the lyricist screenwriter.
Ranaut has argued that the judge had not followed the procedure under the law and had displayed “non-application of mind” in calling him.
HC found “without ground” to disturb or cancel the trial based on the alleged procedural irregularities adopted by the judge while admitting complaints against Ranaut.
“The process of publishing orders, dated February 1, reflects the application of mind and hence, guarantees no interference,” said Revati Mohite-Dere justice, who rejected the actor’s application to find it “without reward”.
Ranana’s advice Rizwan Siddique argues that the judge has not followed the right procedure in directing the police to conduct an investigation that produces “one-sided investigation” when his witnesses are not checked.
He left “less drug” and thus must approach HC to protect his fundamental rights as well as his request.
Siddique then said he would move the Supreme Court.
Metropolitan Magistritan Andheri is scheduled to hear the case on September 14.
Lawyer Akhtar Jay Bharadwaj said Ranaut did not respond to police requests for his statement added that the judge “thoroughly applyed his mind too, and relied on the verification statement of complaints as well as the interview television Ranaut.
