New Delhi: Only proximity to a place of worship, if the distance determined in a row 100 meters is maintained between the two, there is no land to close the water hole, the Supreme Court decides on Friday, observing that while some want to pray, others might want to drink .
The APEX court heard a Petitioner who appealed against Madras’s decision of the High Court refused to close or move the Jothy Bar, 114.5 million from the entrance of the Throwbiamam Temple in Puduchery.
Appearing for the applicant, Nandkumar’s advocate said, “Even if the bar is not closed, it can be moved to honor public sentiment.” He told Judge Dy Chandrachud and BV Nagaratha that because of the small distance between the bar and the temple, many people were drunk and came to the temple and disturbed rituals and festivals.
“Once the distance of the law between the two is maintained, there is a little court that can be done legally.
Temple trust hasn’t objected to the existence of a bar near.
Why do we have to disturb HC’s decision,” Chandrachud said.
A high court bench from the chairman of Judge Sanjib Banerjee and Senthilkumar Ramamoorthy on July 16 has set aside the benchman’s bench command to direct authorities to cancel the bar license.
In the appeal, the HC division bench said, “The distance from the extremities outside the bar area to the entrance of the Throwbiamam Temple is shown 114.5 meters, which far exceeds the prohibited distance.”
