Speaker sanctions are not needed to demand MLAS for criminal acts: SC

New Delhi: The Supreme Court on Wednesday removed the role of the speaker in the prosecution of selected members who were accused of violating in the house by governing that the police did not need a speaker sanction to register parliamentary criminal acts or MLA.
This decision was given by Judge Dy Chandrachud and Mr.
Shah while disposing of the government’s request without previous sanctions from the speaker, the police could not submit FIR calls under various parts of the IPC and the prevention of damage to the public property acted against LDF MLA in 2015 for damaging furniture and Equipment during protest against the presentation of the budget at that time the Minister of Finance.
The need for sanctions from the speaker for the prosecution of parliamentarians caused frustration to law enforcement agencies and others as chairman officers influenced by partisan considerations.

In the case of bribery, SC has ruled parliamentarians and MLA as civil servants.
SC on Wednesday said the obligation to secure the spoke passer is limited to cases in which allegations of commission or negligence actions were carried out by civil servants in the journey of their duties.
