Speech ‘hate’: Problems of Supreme Court Notice to Uttarakhand, Delhi Police

New Delhi: The Supreme Court on Wednesday issued a notification to Uttarakhand and Delhi police in the petition by Journalist Qurban Ali, looking for actions against hatred speeches against the minority community in Haridwar and in the trial in Delhi and in the church.
The petition, which was submitted by Journalist Qurban Ali and the former Judge of the Patna High Court and Senior Advocate Anjana Prakash, had been looking for directions for “independent investigations, credible and impartial” by an incident from the Muslim community.
Appearing for the Petitioner, Senior Advocate Kapil Sibal said Dharam Sansad will hold another church in Aligarh and must be detained from making hatred speeches there while SC seized from this problem.
Sibal said when the selection process turned on, unless preventive detention steps taken against the Dharam Sansad State participant would slip on the ethos.
The APEX court has searched for Uttarakhand’s response and Delhi police with Ali Petition in 10 days and asked the applicant to take him to the notice of the authorities concerned about Dharam Sansad scheduled to be held in the January 23 and his concern about violations of law and his concern about the scoring assessment.
On Monday, the bench led by CJI has recorded the submission of Senior Advocate of Kapil Sibal that there were no actions taken against those who made hatred speech despite registration for Uttarakhand police.
“I have moved this pill in connection with what happened in Dharam Sansad in Haridwar on December 17 and 19 (last year).
We live in difficult times where the slogan in the country has changed from ‘Satyamev Jayate’ to ‘Shastramev Jayate’ , “Said Sibal.
The FIR has been submitted but no arrest has been made, the senior lawyer said, added that there were no actions that might occur without the intervention of this court.
The bench said that it would take a problem to hear.
Application, which specifically refers to the “hatred speech” conveyed between “17 & 19 December 2021 in Haridwar and Delhi”, has also been seeking compliance with the PEX Court guidelines to handle the speech.
One event was held in Haridwar by Yati Narsinghanand and the others in Delhi by ‘Hindu Yuva Vahini’ allegedly “calling for members’ genocide” from a community, he said.
Uttarakhand police submitted FI 23 under the provisions of the Indian Criminal Code against several people including Sant Dharamdas Maharaj, Sadhvi Annapoorna aka Pooja Shakun Pandey, Yati Narsingan and Sagar Sindhu Maharaj.
Similar complaints were submitted with Delhi police for the second event held in the national capital.
The request said that there were no effective steps taken by Uttarakhand and Delhi police.
Until now there is no FIR filed by police Delhi even though the call for ethnic cleaning at the event is set here, he said.
In addition, this petition, another request has also been submitted in the Apex court by Jamiat Ulama-I-Hind to ban anti-Muslim speeches and programs such as ‘Dharma Sansad’.
The petition has demanded strong legal action against those who allegedly threatened Muslim massacres and said it was not only a matter of religion but about the constitution, law, unity and state integrity.
“Hate speeches and statements against Muslims suddenly increased in the country since the last moment,” said the application.
