New Delhi: The Delhi High Court on Thursday took a dim view of efforts by the police to pass the quiet streets of Chandni Chowk during a strict parade of hours of night and republic as a strict no-hawking policy.
The court asked the police commissioner and corporate head of Municipal North Delhi to stay present on the next date, February 28, to explain how they proposed to deal with the threat of illegal hawking.
“Sustainable circumstances show the actions of ad hoc are taken for selective removal encroachment by the corporation and Delhi police, which have not produced the desired results or permanently ending encroachment in the Chandni Chowk Hawking Zone,” a Vipin Sanghi judicial bench and Jasmet Singh noted.
The bench underlines that several orders have been passed by the Supreme Court and the High Court from 2017, “but it seems that almost no increase in the basis”.
It shows how he commands illegal hawking in certain other markets, including Connaught Place and Nehru Place, have been fulfilled by the authorities concerned.
“The time has come to this court to ask the presence of the Delhi Police Commissioner and the corporate commissioner of Municipal North Delhi to explain how they propose to deal with the ongoing threats,” said the court, added that it could not accept the position that the authorities were helpless.
They cannot give up or ignore their legal responsibility because they will lead to anarchy and legal supremacy failure.
A strong order arose after the court examined the status report submitted by the police and found street images from Republican Day and other dating when there was a weekend curfew in the city to show that they had traveled to eliminate encroachment.
Kotwali Sho claims that several photos from other dates are also submitted in status reports to show that sustainable actions have been taken.
However, the bench told the Anuj Aggarwal police adviser, “this does not explain the filing of photos that claim that they have cleared encroachment …
Factual statements are that in these days the police do removal exercises, which in fact, are not done.
This is this is A clear effort to mislead this court.
“It adds that North Corporation has” just showed this fact.
” Sanjeev Ralli’s senior advocate, appeared for Chandni Chowk Sarv Vyapar Mandal, handed over that despite the command of the court, there were still encroachment on the public and road routes.
He also placed photos of seller and hawking activities.
North Corporation Counsel Mini Pushkarna said some actions had been taken to eliminate encroachment.
Last month, the court had asked the police and the corporation to drive to eliminate all illegal vendors of the no-hawking zone.
