Mumbai: The Bombay High Court on Wednesday ordered its verdict for the default guarantee by lawyers and Elgar Parishad / Bhima Koregaon accusing Sudha Bharadwaj.a SS Shinde’s judicial bench and Nijamoodin Jamadar heard Bharadwaj petitions who also urged him to cancel two orders for pune sessions to extend the time for the police Pune to submit a chargesheet and admit Chargesheet.
His advocate Yug Chaudhary argued that Judge K D Vadane’s order was illegal because he was not told as a special judge under the Nia law.
He also handed over that after expiring 90 days of detention there was no legitimate or legitimate order for chargesheet submission and therefore BHard had the right to the default guarantee.
Advocate General Ashutosh Kumbhakoni reiterated the Special Nia Court will hear the only case after it was taken over by Nia and not during the pre-trial stage.
He said until then the session court had jurisdiction to pass the necessary orders.
