New Delhi: The Supreme Court on Thursday said that the social media platform has the strength and potential to influence people on the border.
Debates and posts on platforms like Facebook have the potential to polarize the community because many community members do not have the means to verify the truth of the content, said SC.
The top court made these comments while giving a verdict on the request submitted by Facebook India Vice President and MD Ajit Mohan and others challenged the call issued by the Peace Committee and Harmoni Delhi to fail to emerge before a witness with Northeast Delhi riot issues.
The Supreme Court said that appreciating evidence in a criminal case related to Delhi riots was not in the jurisdiction of the Delhi assembly committee led by Raghav Chadha, which was said should not make a prime facie statement about facebook prosecution in cases of Riots.
“Because the Delhi Majide itself has no jurisdiction over the situation of law and order and police, the Peace and Harmoni Committee will not have a business to comment on Delhi riots, especially criminal cases and proof properties,” said SC.
The APEX court said if Facebook officials decided to appear before the committee, he could not be forced to answer questions and for this, the committee could not continue the violation of the privileges at home.
Previously in December last year, the Peace Committee and Harmoni have moved the court for those who want to intervene in the request submitted by Mohan and others.
On October 15 last year, the center told the court to the proceedings of the peace committee and harmony were “without jurisdiction” as a problem related to law and order.
The Apex Court said that the order of September 23 asked the Assembly panel not to take coercive action against Mohan, it would continue until the order further.
Trees submitted by Mohan, Facebook India Online Services Pvt Ltd and Facebook Inc.
has argued that the committee has no power to call or hold the Petitioner with violations of special rights because it fails to emerge and it exceeds its constitutional limits.
They have challenged notice of September 10 last year issued by the Committee who was looking for the presence of Mohan before the panel investigating Delhi riots in February and the Facebook role in the spread of hatred speeches.
The Delhi Assembly said that there was no coercive action taken against Mohan and he was only called by the Committee to appear as a witness in connection with the Northeast Delhi Riot.
