Supreme Court: Not in the Delhi assembly mandate to call Facebook accused of 2020 riots

New Delhi: The Supreme Court on Thursday said that the Delhi assembly can seek information from Facebook and its officials in connection with their alleged role in 2020 Delhi Riots, but the social media platform cannot be forced to answer legal and order problems and other subjects that fall under the domain center.
A bench headed by Justice Sanjay Kiswan Kauul stressed that Facebook officials could choose not to answer questions, which were outside the scope of the legislative power of the Delhi assembly.
The court over raising the strength of the Delhi assembly to form a committee to examine Delhi riots in 2020 but explained that the committee could not act like a prosecutor agent.
The bench said the Delhi assembly itself did not have jurisdiction over the situation of law and order and police, therefore, the Peace and Harmony Committee could not examine criminal cases and the nature of evidence in connection with riots.
The top yesterday explained that if Facebook officials decided to appear before the committee, that the official could not be forced to answer questions and committees, for this action, unable to continue the violation of the privileges from officials.
The top court emphasizes that it is not in the legislative mandate of the Delhi assembly to say Facebook must be named as accused and demanded in Delhi riots.
The Delhi Peace and Harmony Committee has called Facebook India Vice President and MD Ajit Mohan as an expert witness on Facebook abuse to disseminate hatred content during February 2020, Delhi Riots.
The committee has published a call for Mohan on two occasions allegedly stating that his non-appearance will be treated as a violation of privileges.
