NEW DELHI: The Supreme Court on Tuesday remained a 10-day-old Delhi high court order quashing GST levied on air concentrators, imported for private use or obtained as talent from overseas, although terming the stunt as violative of right to life of individuals, reports Dhananjay Mahapatra.
Referring to this explosion of Covid-19 instances in Delhi and lack of oxygen and oxygen concentrators, an HC seat of Rajeev Shakkdher along with Talwant Singh had mastered the”imposition of both IGST on oxygen concentrators that are imported by humans and are obtained by these as gifts for private use is unconstitutional.” The HC had termed the levy on human importers because violative of right to equality because the nation and its agencies had been exempted from GST on radioactive oxygen concentrators.
Arguing to the Centre which contested the HC sequence prior to the SC, lawyer general K Venugopal said that the HC completely missed the logic supporting statute of GST on oxygen concentrators erased from the government and its agencies, that were to provide the machines without any charge on the destitute and poor.
