Hyderabad: Telangana High Court on Wednesday refused to stay auction land (HMDA) Hyderabad Metropolitan Development (HMDA) in Kokapet and Khanamet in the larger Hyderabad region.
The state government hopes to collect around RS 3,000 Crore from auction, to be held on Thursday.
But the judges will examine the legal validity of the state policy to turn on 1,000 hectares of land in each district as a land bank to auction.
Chairman of the Judge Hima Kohli and Justice B Vijaysen Reddy said this while hearing the request submitted by former member of Parliament Vijayasanthi who questioned state policy.
By stating that this is not a new policy, Telangana Advocate General B said that GO was challenged in the past and the division bench from the High Court has upheld them.
“The country is empowered based on Article 298 of the Constitution to sell its assets and thus can monetize assets for public purposes,” he said.
Appearing for HMDA, Senior Advisor S Niranjan Reddy said that despite certain amendments to the rules to prevent selling urban land parcels, this did not eliminate the power of the empty state.
This is especially true if the land slips into the hands of encroachment and if it is difficult to protect them.
Vijayasanthi T advice is Rajasekhar said that the state expressed the inability to protect the land itself unacceptable.
“How can the state inspire trust if you cannot protect the land itself?” He asked.
“State on the one hand said that it would only sell the packages that were difficult to protect and on the other hand, asking for officials to create a thousand hectares of land banks in each district for the purpose of getting income.” The bench issued a notification to the State, HMDA and GHMC and said it would not allow the sales notice.
However, Gos related to land auctions did not stay.
“This limited limit and we don’t mean to stay,” Bench said.
