The army to provide a permanent commission to 11 women

New Delhi: The Center and Army on Friday agreed to provide permanent commissions to 11 female officers and also to consider other officers’ requests with “open liver and open minds” after the Supreme Court began to dictate the command holder to hold the Army guilty of insults .
At the beginning of hearing, the general lawyer of General Sanjay Jain and Senior Advocate R Balasubramanian, appeared for the center and the Ministry of Defense, told Judge Dy Chandrachud and as Bopanna, a command had been forwarded to give the 39th commission to the 71 officers who were previously rejected but not Can be given to 11 officers who, together with others, apply for insults in SC against the army’s head.
They propose that there are bad findings against them during the relevant period and if they are given a PC then it will cause flooding litigation as other officers, including their male colleagues, will seek the same help.
The bench, who hears the third round of litigation on a PC for a female officer, clarifies that it will go with the previous assessment where it has a fixed criterion to provide a PC.
Referring to the bad comments on the officers, the bench increased the question of why they were rejected by the permanent commission when they continued to serve the army.
“We found that the soldiers were guilty of insults and we will pass the command.
The army may be the highest in his own authority but the Constitutional Court is the highest in his jurisdiction.
We have given you a long rope.
But you are now in trouble,” said the bench and started dictating order.
Feeling the atmosphere of the bench, the government lawyer immediately deals with the authority concerned, which surged into the actions to ward off shame was held guilty of insults and immediately communicated instructions to lawyers.
Jain then told the bench, which was then dictated by several paragraphs of the order, that he had received instructions to notify the court that the remaining 11 officers would be given a PC within a week and the petition of other officers placed will also be considered and the order passed in three weeks.
He said that the government had made a decision by considering the “hearing flow” in this case.
The court then recorded Jain’s statement that the permanent commission application for all female officers would be decided according to the criteria mentioned by SC in its assessment in March.
The court has said that all women’s officers who have fulfilled the cutoff value of 60% in the selection board held in September 2020 must be entitled to a PC, subject to their meeting of medical criteria and accept disciplinary and alertness permissions.
The court then appreciated the efforts made by Sanjay Jain and R Balasubramanian in resolving this problem.
There are 72 officers who are rejected by a PC.
One officer then looked for the premature release of the service.
Thirty-five officers moved the insulting petition in SC against the army’s head; 21 Among them are also given PCs and three are found medically not feasible and the request 11 applicants are rejected.
The bench also explained that the PC will also be given to female officers who are not approaching the court but fulfill the requirements according to the March assessment.
