The bank lost Property MAN paper, ordered to pay Rs 25,000

Gayatrinagar Resident T Venkatesh approached the Gayatrinagar Bank branch in August 2006 for a loan Top-up Rs 2.5 Lakh on a housing loan Rs 74 Lakh.
He handed over the title deed and other documents from its property to the bank and received a loan approved by an annual interest of 8%.
On March 2, 2020, Venkatesh cleaned the loan and obtained a ‘non-maturity’ certificate from the bank, but the branch staff failed to restore the original document.
The staff averves it for days, making it difficult for him to sell original paper properties because prospective buyers quote prices very low because of this.
Realizing the staff had lost its property papers, he sent them legal notice on May 26, 2020.
He filed a complaint against the General Manager’s head, regional manager and Gayatrinagar branch manager with the Consumer Disputes, Shantinagar.
Litigation began on August 24, 2020.
Venkatesh’s lawyer presented the case, while the bank’s advice argued that complaints were wrong and unfounded but recognized that customer property documents could not be tracked.
He said the bank had filed a police complaint and published this problem in an English newspaper.
The loss of unintentional documents and therefore there was no shortage in service in the bank, he argued.
In the assessment submitted on February 7, 2022, the forum judge ruled the customer had paid his contribution to the bank and did not return the document as much as deficient in the Bank’s service.
However, Venkatesh claimed a higher value for its properties near the Metro station, which failed to be proven in court with suitable documents.
Considering RS 2.5 lakh loans he has deleted, the court ruled that the bank must provide a copy of the certified document mentioned by the complainant with its own expense, in addition to paying Rs 20,000 as compensation and RS 5,000 on the cost of the court, all within 30 days of the court order.
