Mumbai: After the police told that a developer who stopped appearing in court had fled to the United States, Bombay High Court on Monday directing his two partners not to take previous permits.
“We learned from such things to first pass the order not to leave the country,” Judge Shahrukh Kathawalla and Millind Jadhav.
They heard five petitions by flat buyers against Jayesh Rami, Rajesh Savla and Ashwin Mistry who were partners and Director of Raj Arcades and Enclave Pvt Ltd.
They “cheat” some flat buyers and also Anand Rathi Global Finance Ltd.
(argfl) in connection with their project, Raj-Shivganga, in Babredkar Nagar, Kandivalali (West).
The trio collected a large number of flat buyers in 2010-11, issued a rationing letter and signed a registered agreement for sale in 2018-19.
In 2017, they mortgaged 22 flats to Argfl, from whom they had borrowed Rs 12 Crore, misinterpreting that they were not sold.
Argfl wins in the process before a judge.
On November 10, HC directed it to not have a flat.
On November 12, the three directors appeared in court.
The court recipient is directed to have the Kandivli office and their auction.
Judges also seek disclosure, including their assets, bank accounts and returns.
On November 18, Hemp advocate said he could not be contacted.
The judges directed him to attend November 22.
Because he did not appear, the judges issued a brave warrant.
On November 30, the judges issued an unfolded warrant after the senior inspector of the Kandivli police station told them they could not trace hemp.
On Monday, the judges were told by a police officer that Hemp daughter-in-law told him that he went to the US through Dubai on November 18 when he was directed to appear in court.
Also, his wife and son live in the US.
The judges then directed the daughter-in-law to stay on Tuesday so “at least he could give details”.
“It seems that the whole family is in the US.
See that two other directors did not go to the US,” Kathawalla justice said.
Resisting Savla and Mistry, the judges were directed “they will deposit their passports in court” on Tuesday.
