New Delhi: The West Bengal Government on Wednesday moved the Supreme Court to challenge Calcutta HC’s orders to direct the CBI’s probe into violence after the poll in the state on the ground that it did not expect a fair probe as an agent, on orders from the center, targeting state leaders and TMC.
Submitting a special petition against the order of HC on August 19, the state through Advocates Sukan Mukherjee said the CBI had been involved in the hunt for wizards against state officials and TMC leaders and that it captured the agent to use violence after the poll as Ruse to expel false cases against TMC MLAS and Minister.
It is said that the state has filed a native lawsuit under Article 131 of the Constitution to increase the middle state dispute over a terrible violation of the federal structure of the Government by the CBI in registering cases in the state even though the West Bengal Government attracted an agreement that allowed agency to investigate cases in in the country.
SC previously decided that the CBI can investigate cases in countries, which have attracted general approval, only on the direction of HCS or SC or with the previous state approval.
But the state said that HC could not direct the CBI probe to undermine the role of the state police, which had immediately registered first and effectively in complaints of violence after the poll and arrested the people accused.
The state said that he understood that the center would use the CBI to expel false cases against the state functionaries with the inspection of the investigation into violence after the poll.
