Jodhpur: Trapped since September 2018, the famous abduction and murder trial of Bhanwari Devi returned to stone.
The US-based FBI DNA expert and the witness of the Important Prosecution Amber B Carr was again summoned by the court of trial, although 20 similar attempts failed before.
All witnesses relating to this case had been questioned in court except Carr, which was a witness to an important prosecution in this case, because he had conducted a DNA examination of the bones recovering from the canal and claimed to be Bhanwari Devi.
According to the defense advisor, he has published a call of 20 times between May 2017 and September 2018, but he has stated he is not interested in respecting the call which quotes diplomatic reasons over and over again.
“To secure his testimony, the CBI has asked permission from the court and the High Court to undergo an examination through video conferencing.
But the application has been rejected after opposition hard by defense lawyers”, advisors said.
Then, the High Court, while leaving defense advice prayer, has directed the trial court to continue the trial by recording the accused statement, dropping Carr as a witness.
Challenging this high court decision, the CBI has transferred SLP at the Supreme Court, which has directed the court of trial to continue with a new call for Carr.
“But this permission has been given in the condition that if the CBI fails to get Carr to the court to be examined, the petition will be deemed discarded without carrying court notifications”, said a defense advisor.
In fact, according to the direction of the APEX court, the call was issued to Carr by the court of trial, almost no hope for the CBI, which had given Carr’s physical presence in court 20 times without choice.

However, the High Court, in the order in November 2019 has directed the trial court to continue the statement accused of holding a trial by waiting for Carr, but said that his order would remain a decision about the CBI SLP in court.
