VARANATION: MP BSP from Ghosi Atul Rai, who was in prison in a rape case where the witness’ complainant also died after making self-immolation near the Supreme Court in New Delhi on August 16, failed to get tough as an application.
For further investigation in his case was rejected by MP-MLA Court, Prasagraj on Thursday.
The court has fixed September 7 as the next date to record the defendant’s statement in this case.
Talking to Toi, Advisor to the District Government (Criminal), Prasagraj, Gulab Chand Agrayah said, “The request for lawyers who were imprisoned in demanding further investigation in his case was rejected by the MP-MLA court.
Defense lawyers have submitted a request below part 173 (8) CRPC , demand further investigation into the case of rape.
During hearing this application on August 27, I have opposed it strongly stating that they have no locus position, because after submitting a chargesheet in any case only the police can require permission for further investigation.
Finally , the court refused the request.
“According to agrahari, now the next date in this case has been designated as September 7, when a statement of people accused of this will be recorded in the presence of MP-MLA Court.
“Previously, the companion and colleague, who was also the main witness in the case of rape against Rai, has recorded their statement before the MP-MLA Court,” said Agrari, added, “Apart from them, the other witnesses including the former office station station Police Lanka Varanasi Bharat Bhushan Tiwari, Investigation Officer and Sub-Inspector RC Pandey, Constable Head of Raghav Rai, Dr.
Rashmi Gupta, Constable Priti Rawatan, Amit Srivastava and Shiv Kumar Gaud and Security Guard from Apartments where the incident has also been recorded before the court this.
“on May 1, 2019, Ballia woman who complained and former leader of a college student in Varanasi has filed a rape case against the police Lanka Rai in Varanasi, alleges that on March 7, 2018, he had checked it to her apartment.
After submitting this case, Rai portrayed the 2019 parliamentary election as absent from BSP tickets.
He has managed to win the Ghosi parliamentary seat.
Then, he gave up before the court on June 22, 2019, and had been imprisoned since then.
The police have submitted a chargesheet against Rai and heard in this case taking place at MP-MLA Court in Prayagraj.
Some efforts to terrorize complainants and their families were made allegedly by Rai and his men.
Efforts to submit cases against him were made by the Helper near Rai, accusing members of the complainant family.
On August 16, the complainant and his friend leveled serious charges against many police officers and others through Livestreaming on Facebook before igniting themselves.
During treatment, his colleague died on August 21 while he gave up to burn injury at the RML hospital in New Delhi on August 24.
Burning himself by the Duo caused actions against a number of police officials, including Amit Pathak excavation while previously IPS Amitabh Thakur was arrested in Lucknow on charges of reducing suicide of rape victims and major witnesses after submission of reports with SIT which was formed by the state government in this relationship.
