Chennai: conductor with metropolitan transport Corporation which was suspended for the cash deficit was only RS 3 during inspection by the MTC check inspector has succeeded in opposing its suspension at the Labor Court.
The court has set aside orders and directs MTC to issue consequential benefits because of employees.
The court noted that the suspension order was issued without conducting a domestic investigation and directing the previous suspension to be set aside.
But the court argues that transportation companies can conduct fresh investigations if needed.
Transportation unions, which transferred the petition on behalf of conductors, Karanji, stated in their petition that the conductor was suspended on December 17, 2005 after the inspection inspector found a three-rupee deficit and served with a memo for non-co-operation and poor treatment of superior officers, carelessness and indifference , in which Kalanji provides an explanation.
However, without considering the explanation and without conducting a domestic investigation, the conductor was given a year-long cutting punishment, where trade unions were moved.
The corporation, in response argued that the conductor was a serial actor and argued for the petition to be dismissed.
Mastering the Officer of the Principal Labor Court, Chennai, C Kumarappan, after reading the shipment observed that in accordance with the order of transporting the transportation corporation, he was obliged to carry out domestic investigations before giving penalties or fines.
“Therefore, this court does not hesitate to hold that the sequence of suspension is responsible for being set aside.
Even so, this corporation is given the freedom to have a domestic investigation into the conductor in accordance with relevant laws and order stands,” said the chairman stated that the conductor has the right have consequential benefits.
