KABUL: The decision to implement the King Zahir Shah era constitution in Afghanistan is not final, according to a source.
Source, talking to the terms of anonymously, said the government had not resolved the decision to enforce the constitution, reported Tolo news.
Previously on Tuesday, the Ministry of Justice Taliban said that the constitution of the era of King Zahir Shah would be enforced for the interim period.
Officials from the Cultural Commission of the Ministry of Information and Culture said that the constitutional articles installed in 2004 (current constitution) did not conflict with sharia law, they would still be used until the new constitution was announced, reported the tolo news.
Anaamullah Samangani, a member of the Commission, said efforts had begun to develop a new constitution based on the Quran and Sunnah.
“The government works so that Afghanistan will have a constitution that can overcome the demands of a real Islamic system,” he said.
Meanwhile, a number of lawyers say most of the constitution of the Zahir Shah era is not compatible with the current situation, reporting Tolo news.
According to lawyers, most of the first chapter of the constitution is about the constitutional monarchy and the king authorities.
Article Four Constitutional Era Shah said the Afghan flag was tri-color and chapter six said the king symbolized the national sovereignty of Afghanistan.
“Upholding the Constitution in 1964 can be questioned to the Afghan people because the constitution was compiled for that period,” said Subhan Misbah, a lawyer.
The constitution of King Zahir Shah has 11 chapters and 128 articles.
The constitution was ratified in 1964 by Loya Jirga (Grand Assembly).
King’s constitutional Zahir Shah was also temporarily implemented during the first years of Hamid Karzai, according to Khaama Press.
