Jaipur: Nearly 60 years after Major Shaitan Singh, Param VIR Chakra, was killed in the action during the 1962 war, his family had not received their contributions only despite the legal battle for years.
After Singh died, his wife, Sugan Kanwari, used to receive only a normal family pension even though he was eligible for a special family retirement, which was around 60% of the salary of the dead soldier.
Even the number of Gratification Rs 4,000, which was given in 1963, recovered from retirement in 1964 and has not been given back.
After the revision in 1972, the family of the war hero should get a liberalized family pension, which applies to the next KIN (NOK) from defense personnel who are victims of the battle.
But Sugan did not get this until 1996 and was deprived of the previous contribution (from 1972-96) too.
Sugan died in 2015, but the legal process to recover contributions was happening.
His son, now a senior citizen himself, struggles for arrears and percent.
Even now, the end of this legal battle is not visible because there is no judge in the Armed Court (AFT) in Jaipur since 2016 where the case was delayed.
Advocate Colonel SB Singh (retirees), which fought with the case in Jaipur AFT for the family, told TII: “In normal retirement, NOK is given 30% of the temporary salary in a special retirement is 60%.

However, Sugan Kanwari, wife of Mayor Shaitan Singh, was only given a normal pension.

Major Shaitan Singh was originally assigned to Jodhpur State forces on August 1, 1949, after training from Ots Pune, from August 26, 1947 to 31 July 1949.
Then, he was given a short service regular commission in April 1,1951, and regular permanent commission, on May 25 1954, with Kumaon regiments.
During the 1962 war, he was killed while maintaining his company’s locality against Chinese soldiers as part of the 13 Kumaon regiment.
He was awarded the VIR PARAM chakra for his courage and sacrifice, Anumertor.
However, the government’s apathy in completing retirement and arrears forced the family of soldiers to find legal routes.

In 1996, he began receiving a unlabored pension.
The current case is for arrears from year 1972 to 1995 and the percentage.
After his death in 2015, his son should be given arrears.
But there was no judge in Jaipur AFT since 2016 because his case was delayed.
