New Delhi: The government has changed the rules relating to the merger of the company based on the Company’s law, 2013 and these changes will take effect from September 1.
The Ministry of Affairs, which implemented the Company Law, 2013, has changed the company (merger) of the rules, 2014.
In the rules, changes have been carried out in connection with the allotment of a new name to the company below part 16 of the law.
Section 16 is related to repairing the company’s name with various conditions, including that the government can direct the company’s name if identical to or too resembles the existing company name.
If the direction is incurred, the same thing must be implemented by the company concerned within three months.
Now, the Ministry has placed a new rule where the ‘Ordnc’ tag (the order of regional directors does not meet) will be attached to the name of the company that does not comply with the direction in the specified period.
For companies like that, the letter “Ordnc (which stands for the sequence of the regional director’s words does not comply ‘), year through direction, serial number and the existing company identity number (CIN) must be a new name of the company without further action or deeds by the company, “according to the notice.
Furthermore, the company’s applicants will make the entry of new names in the company list and issue a new merger certificate, he added.
According to the ministry, the company name has been changed, then the necessary steps must be taken to comply with section 12 of the actions related to company registration.
According to the new rules, ‘Ordnc’ must be “mentioned in parentheses under the company name, where the name is printed, affixed or carved”.
In other notifications, the Ministry said the provisions of Part 4 of the Act would take effect since September 1, 2021.
Part 4 related to the company’s memorandum.
Notifications issued on July 22.
At the end of June, there were 13.7 lakh registered companies active in this country.
From them, more than 17,200 new companies were established during April to June this year.
