New Delhi: The government has been released by certain agencies from the scope of the act of 2016 Act Disability Section which provides for reservations at work for a benchmark disabilities, according to sheet notice.
In the first part of the notification was issued on Wednesday, the government was released all categories of posts under Indian police service; All post categories under Delhi, Andaman Islands and Nicobar, Lakshadweep, Daman and Diu and Dadra and Nagar Haveli Police Service; And all categories of posts under the Indian Protection Force Service train.
In the second notification, liberation from the section must be given to all sectors and post-commercial post categories.
“In the implementation of the power provided by the provisions for sub-sections (1) Section 20 and the second requirement for sub-sections (1) of Article 34 concerning the Rights of Persons with the Disability Act 2016, the Central Government, consulted with the Main Commissioner for Disabled, with pay attention to the nature and type of work, hereby release all categories of combing personnel from the Central Police Armed Forces, namely, Force’s border security, the Central Reserve Police, Central Industrial Security Forces, Indo-Tibet Police Border, Sashastra Seema Bal and Assam Rifles from these provisions Section, “said the second notice.
According to Section 34 the Rights of Persons with Disabilities (RPWD) Act, 2016, every right government must refer to every establishment of the government, no less than four percent of the total number of vacancies in the strength of cadres in each post group intended with persons with disabilities, one percent Each will be provided for a benchmark persons with disabilities.
Section 20 of the law for non-discrimination in work, reasonable accommodation and proper barriers and a conducive environment for employees with disability.
Meanwhile, activists have opposed the government’s decision.
Arman Ali, Executive Director, National Center for Work Promotion for Persons with Disabled (NCPEDP) said releasing parts 34 of the laws conducting “grave injustice” for people with disabilities.
“The work under the police department is not only limited to field work, but also contains sub-departments such as forensics, cyber, IT cells, among others, who can accommodate people with disabilities in work identified for them.” The reservation provided under Article 34 Only to the work identified in section 33 and therefore, the notifications incurred are irrational as persons with disabilities have been considered suitable to be appointed in the post identified, “he said.
Ali further added that people even with disabilities such as victims of healed acid and leprosy attacks were able to carry out the law and order of duties and responsibilities under the police.
“Thus, the blanket of liberation in all categories of police and IPS is unfair and arbitrary in nature,” he regretted.
Activists also said liberation from section 20 will have negative implications for people with disabilities that have worked under the word combatant services.
For example, if employees employed in one of the word combatan services acquire disabilities during their service period, he will not be able to implement reasonable, non-discrimination, promotional accommodation if fighters are released from the provisions of Part 20 of RPWD Act 2016, he said .
The National Platform for the Rights of Persons with Disability (NPRD) said the government had “misutilized” requirements under section 34 which provided the release.
The purpose of this provision is not to provide exemption of blankets from hiring people with disabilities, but to see that the role of combatant or task is not given to them and in any case, the recruitment is only the post identified, he said.
NPRD Secretary General Muralidharan said the development was militating against the spirit and objectives of conditions.
“It’s even more surprising given the fact that Delhi’s police have been in October 2019 advertised for the police chief (minister) providing orders for people with disabilities,” he said.
“Strangely, in another notification issued on the same day (August 18), which is related to the Central Police Armed Forces, limited release is only for the category of combing personnel ‘posts,” he said.
Calling the first notification “unacceptable”, the NPRD calls for withdrawal.
“Exceptions must be given only in cases of ‘combatan roles’ in accordance with the spirit of the intent and from the provisions below article 34 of the RPD Law.
It is very regrettable that a department that should protect the rights of persons with disabilities and empower them, do the opposite, “Muralidharan added.
