The government is not likely to reduce the age limit to deal with adolescents in the case of Pocso

New Delhi: Responding to the recommendation of parliamentary panels that call for reviewing the current age limit of 18 years and see whether it can be reduced to 16 years for teenagers involved in serious crimes under the protection of children from sexual laws, The Ministry of Female and Child Development It has explained that the provisions of the 2015 Juvenile Justice Act have sufficient provisions to deal with adolescents between 16 and 18 involved in cruel crimes.
The affirmation of the WCD Ministry comes in response to the recommendations and observations of the Committee on reports on cruelty of crimes against women and children, submitted in parliament in the budget session earlier this year.
The committee remains in home affairs, in his report submitted in parliament on Tuesday, paying attention to replies and not providing further recommendations.
This is important because it brings final speculation triggered by the previous recommendations that the government will consider reviewing age.
Parliamentary panel, led by Anand Sharma, recorded answers from the WCD Ministry, where he told me that a child accused of crime under Pocso Law was protected under the provisions of the JJ Law, 2015, based on the restorative principles of justice.
“JJ’s actions empower the council of the Youth Justice to decide on the things of children contrary to the law.
Furthermore, violations committed by children have been categorized as a small, serious and vile violation.
JJ Law, 2015 also included the procedure for deciding cases Where children over the age of 16 are allegedly committing violent violations, “stated.
The committee in its recommendations has noted that there have been a large number of cases under the Pocso Law where adolescence under the age of the threshold for the application of law.
“The Committee believes that small sexual violators can commit more serious and vile crimes if they are not treated / unstimated.
Therefore, it is very important to take the relook on these provisions because more and more teenagers are involved in the crime.
The Committee, therefore , recommend that MHA can take with the female ministry and children’s development to review the current age limit of 18 years and see whether it can be reduced to 16 years for the application of Pocso Law, 2012.
“Record replies in the WCD Ministry in the report, the committee said that” It doesn’t desire to pursue this problem considering the government’s answer “.
