The Hungarian court hit the Order for the EU sanctuary decision

Budapest: The Hungarian Constitutional Court on Friday hit the offer by Prime Minister Viktor Government Organizes to challenge the decision by the EU punishment on the harsh policy of Budapest asylum.
Budapest has asked the court earlier this year to review the verdict from European courts who ordered him to suspend the law that allowed the police to deport or physically “pushed back” asylum seekers on the Serbian border.
The petition by the Minister of Justice Judit Varga “cannot be the subject of the review of the ECJ assessment,” also cannot lead to “examination of the superiority of the UE law,” the Hungarian court said.
But it is said that in the joint jurisdiction regions between Brussels and Hungary, Budapest has the right “to ensure the effectiveness of competency training”.
The verdict on Friday is a “milestone decision”, said Varga afterwards in a Facebook message.
That means Budapest can “adjust its national rules with reality by adopting additional steps that are unique,” he said.
“With this assessment, the Constitutional Court has built a strong legal barrier than the physical closure of our borders,” he said, referring to the border fence along the south boundaries of Hungary.
But Hollowki Hungarian committee rights group rights praised the verdict of the Constitutional Court.
“Efforts to sacrify Budapest Law ECJ have failed, the Constitutional Court refused to question the superiority of the EU law,” he said in a statement.
“There is no green light to ignore the ECJ decision, there are no more reasons, the pushbacks must end now,” he said.
Last month, during a trip to Budapest, Commissioner of the European Union Justice Didier Reynders said that the challenge of the ECJ verdict was “unacceptable”.
Moving Hungary reflects the verdict of the Polish Constitutional Court in October which challenged the UE law and dropped blocks into a crisis.
Orban then signed the government’s settlement to support Warsaw who called for EU institutions to honor the sovereignty of 27 members of the Bloc member.
“The virtue of the EU Law can only apply in areas where the EU has competence, and the framework for this is stipulated in the EU founder agreement,” the Constitutional Court said.
The National Law Enforcement Agency, especially the Court and Constitutional Court, has the right to examine the scope and limit of European Union competencies, he said.
Budapest, such as Warsaw allies, has long been involved in squirming with Brussels on legislation targeting LGBTQ people, independent media and civil society.
