New Delhi: One of the police witnesses in the case of Riot Delhi northeast lying in oath, the Delhi court has said after one police officer identified three suspected rioters but others said that they could not be identified during the investigation.
“This is a very sorry situation,” said the Additional Judge Judge Vinod Yadav, looking for a report from the Deputy Commissioner of the Police (northeast) in this matter.
He made observations after an examination of four witnesses prosecution in this case, related to the riots of February 2020 where 53 people died and more than 700 were injured.
In particular, the police chief told the judge about oath in his proof that he had identified rioters – Vikas Kashyap, Kashyap’s goal, and Rinu Subziwala.
He is one of the witnesses of prosecution.
“I have defeated the regional officer in question since 2019.
I know all four of the people were accused and Vikas Kashyap, Kashyap’s goal, and Rinu Subziwala with their names and performances before the incident,” he said during the examination.
ASJ Yadav noted that the police were “firmly firm” about their presence in place during riots and identified them with their names and professions.
On the contrary, the witness was another prosecution, an assistant sub-inspector stated that the three were accused, although specifically named by the police chief, could not be identified during the probe.
“I have been looking for the remaining three people accused but they cannot be traced,” he told the court.
Meanwhile, the investigation officer (IO) the case said that there was no record to prove that the three defendants were investigated even though their names were there in the notes.
Judge then noted, “On the contrary, it is stated that the identity of the people accused cannot be established during the investigation.
There is no material noted that the efforts ever done by IO to arrest the people accused of saying.
Prima Facie, one of the police witnesses Lying an oath can be punished under Section 193 IPC.
“It was also taken to court notice by the defense advisor that these three people were also specifically named as accused of being accused of other pine but even in that case they were not interrogated.
The court has completed the recording of proof of prosecution and registered the problem of recording statements of people accused of October 30.
This case was registered in two complaints submitted by the Bhagrathi Vihar Delhi area which accused that the mass of riots was robbed and harmed their property in February.
