New Delhi: The Supreme Court on Wednesday searched for responses from Jharkhand and the Union Public Service Commission in the petition that accused the FLOUTING Country Assessment of SC improve a two-year term for the Director General of Police and UPSC which failed to form a panel for the new DGP selection.
Chairman of the Chairman of the NV Ramana and Judge initially Hrishikesh Roy initially wondered why applicants Rajesh Kumar had chosen to file an insulting petition instead of direct petition but senior advocate Sidharth Luthra assured that there was a violation of SC orders which clearly provided a two-year minimum period for DGPS.
PIL, put forward through Pranaav Sachdeva advocate which is also a standing advice for the Chhattisgarh government in SC, states that the Jharkhand government was led by Hemant Soren, which took over on December 29, 2019, was abolished by DGP KN Chaubey even though he was appointed May 31, 2019 and According to SC assessment in the case of Prakash Singh will have a term until May 30, 2021.
The Petitioner said the Jharkhand government appointed MV Rao as DGP AD Hoc on March 16, 2020, which was not addressed under the DGP appointment process set by SC in the Prakash Singh Decision 2006.
Kumar Furthermore alleged that the state had exacerbated insult by appointing Neeraj Sinha as DGP on February 11 this year as the successor to Rao.
According to SC assessment, a country is asking UPC to provide a senior officer’s name panel to the country before the DGP retirement period.
The country on July 21 last year asked UPSC to form a panel of officers from whom the DGP could be chosen by the government.
UPSC refused to say the state must comply with the law set by the court.
It is not clear from what petition means upsc – whether it means Jharkhand should provide a two-year Chaubey or the country’s request is not in accordance with the scoring assessment.
Request regunitas by the Jharkhand government meets a similar response from UPSC.
When Jharthan wrote another letter last year demanding UPC to form a senior police officer panel for the DGP Post, UPSC said it was unable to accept the country’s request without direction from SC.
In the Prakash Singh decision, SC said, “The state Thedgps will be chosen by the state government of the three senior officers – most departments that have been returned for promotion to the ranking of the Union Public Service Commission on the basis of their length of service, a very good record and various experiences to lead to the police.
And, as soon as he was chosen for the job, he must have a minimum of at least two years regardless of his retirement date.
“” However, DGP may be released from his responsibilities by the state government acting through consultation with the Commission State security is based on any action taken against it under the Rules of the All India Services (discipline and appeal) or following his belief in court.
