Kathmandu: The Supreme Court of Nepal on Monday returned the dissolved representative council and ordered the appointment of the President of the Nepal Sher Bahadur Deuba congress as prime minister within two days.
The five judges led by chairman Cholendra Shumsher Rana had concluded hearings in the case last week.
Reacting to the SC decision of CPN-UML spokesman and former Foreign Minister Pradeep Gitawali told TI that his orders were unexpected and contrary to the basic principles of the Constitution.
“Wrong and cannot be justified but will obey it,” he said.
President Nepal Bidya Bhandari has dissolved the house down a second time in five months on May 22 and announced the selap selection on November 12 and November 19 based on the recommendation of PM KP Sharma Oil.
As many as 30 petitions were submitted at the Supreme Court against the move.
A petition submitted by opposition parties has demanded the recovery of houses under parliament and the appointment of the President of the Nepal Sher Bahadur Deuba congress as Prime Minister.
The Constitutional Court bench APEX concluded the trial of the Writ petition on July 5.
A four members of Amicus Curiae also presented his opinion about the case of home dissolution.
It still has to be seen how the Election Commission took place after this decision from the Supreme Court.
The body of the poll last week announced a schedule for the upcoming Midterm poll.
Nepal plunged into the political crisis on December 20 last year after President Bhandari dissolved home and announced new elections on April 30 and May 10 on the recommendation of the Prime Minister of Oil, in the midst of the upheaval of the powerful Nepalese Communist Party (NCP).
In February, the Puncak Court returned a dissolved representative board even as the Prime Minister of Oil was preparing for the poll.
Oil repeatedly defended his move to dissolve the House of Representatives, said some of his party leaders tried to form a “parallel government”.
