New Delhi: In the sharp criticism of the upper government, the Supreme Court Friday asked why Ashish Mishra was accused of Son of Union Minister Ajay Mishra, has not been arrested in the case of the violence of Kheri Lakhimpur.
Noting Ashish has been ordered under the SEC 302 IPC (murder), the bench CJI N V Ramana and Judge Surya Kant and Hima Kohli said they were not satisfied with the actions taken and the claim of the state seemed to be “only with words”.
It added, “We hope it (country) will take the necessary steps”.
Advocate Salve Harish, appears for the government over, acknowledging there are irregularities in the administration and say “what they have done is hash”.
Repair action will be taken, he convinced the court.
SC also objected to the Sit composition, by saying only local police was part of it.
It is said to be studying other investigative modes.
The CBI probe is not a solution because “some reason”, said SC, maybe because Senior Mishra is a minister.
This is the way the other accused of being treated: SC court wonders when violence and eight losses are serious cases, why the state authority does not continue the way they should have.
“Whether the way you treat accused in another case (murder case) too: issue notices to them to appear and don’t catch them,” said the bench, added there was a “straight statement” of eyewitnesses in this case.
Message: All defendants must be treated in the same way regardless of their background.
The police must act responsibly and with sensitivity in handling the case of Kheri Lakhimpur to inspire trust among people, said SC.
The bench expressed a surprise on the state police who called on charges to appear before him in serious violations instead of arresting them.
Their statement following the ointment said the notification was issued to be accused, including Ashish Mishra.
Salve agreed that there was a very strong case against “youth” (Mishra) and the accusation of it was very serious.
He said the notice was released for him because the postmortem report did not show a shot injury.
He said the defendant had been asked to appear at 11 o’clock in the morning on Saturday, failed to be caused by the “harsh law”, signaling he could be detained.
While delaying hearing for October 20 when it will further examine the actions of the state government before passing orders, the bench said the state must take all steps to protect the evidence.
