New Delhi: Five days before the National Feasibility Permit (NEET) test for all-Indian quota seats in the undergraduate and medical program, the Supreme Court on Monday entertained two piles submitted by doctors from 15 states and the United States challenging the decision center to introduce 27% OBC and 10% Ordering Parts (EWS) are economically for this chair.
Judge Dy Chandrachud, Vikram Nath and Hima Kohli issued a notification to the center, the Medical Counseling Committee and the National Examination Board after the hearing argument made by Senior Advocate Arvind Flat and Vikas Singh, which appeared for 27 doctors from Chhattisgarh, Goa, Up, Andhra Pradesh , Haryana, Karnataka, Kerala, Chandigarh, Gujarat, Maharashtra, Assam, Delhi, Madhya Pradesh, Odisha and Punjab.
Recently, Madras High Court has upheld OBC booking 27% in all-Indian quota in government medical colleges throughout the state but crashes a quota of 10% EWS in the field that it allows total bookings to pass 50% ceiling.
Flat said that this fresh direct petition could be heard along with the petition that challenged the command of Madras HC.
The applicant said that in 2007, the Supreme Court had introduced a 15% reservation for SCS and 7.5% for ST in the AIQ scheme.
With the introduction of the OBC and EWS quota, the total order in the AIQ seat will slap up to 59.5%, which will violate the assessment of the Supreme Court of Landmark in the Indra Sawhney case where the constitutional bench has limited a total reservation at 50% to prevent reverse service discrimination.
