New York: The US Judge on Thursday hit the Purdue Pharma bankruptcy plan because it gave several immunity for the owner of the company in exchange for a $ 4.5 billion payment to the victims of the opioid crisis.
In his decision, seen by AFP, Judge Colleen McMahon said the federal judge who approved the planned bankruptcy of pharmaceutical companies in September did not have the authority to prevent legal demands in the future against Sackler family members, except in the case of intentional violations.
Forty-three US states have approved the plan but the Ministry of Justice and a handful of other countries challenged him.
They argue that it denies victims of the right to demand the company.
Under the completion of Purdue Pharma, Oxycontin Manufacturer, will be dissolved and the Sackler family established and benefited from the company must pay $ 4.5 billion.
But they cannot be taken to court again for the drug.
The opioid addiction crisis caused more than 500,000 death overdose in the United States for the past 20 years.
Facing Longsigation Avalanches, Purdue last year became guilty of three criminal demands for its aggressive impulse to encourage oxycontin sales, very addictive painkillers.
Under the terms of the agreement, the company will be sold in 2024 to be replaced by new entities managed by trust, and their involvement in the sale of opioid products will be limited.
Purdue will also be asked to make a repository for tens of millions of documents detailing sales and marketing practices.
