New direction, announced on Friday, did not make enforcement of immigration and customs from starting the process to deport women who were pregnant, breastfeeding or giving birth in the past year.
But they generally will no longer be detained waiting for the results of their case except in “extraordinary circumstances,” the body said.
Pregnant migrant detention practices have been condemned as a threat to maternal and fetal health by a critical women’s advocacy group against immigrants and medical care women in detention centers.
“This reflects our commitment to treat all individuals and dignified while still imposing the law of our nation,” said the Director of Es Tae Johnson.
The change was part of a broader effort by the gift of Biden to play back Trump -Purfing steps and return to policies that resemble those under President Barack Obama.
Ice recently adopted the draft guidelines to focus concerns in people in the United States illegally, pose a national security threat or have committed serious crimes.
While these efforts have angered the opponents of immigration, the number of people in immigration detention has increased by LY sharply in recent months.
There were more than 27,000 people in ice-resistant, up from less than 14,000 at the end of March, according to data compiled by the Transactional Access Clearinghouse at Syracuse University.
Nearly 80% of those who are in custody ice do not have criminal records, and the majority of those who commit a small violation, according to Trac.
Advocates praised the announcement of Friday, but said it was not far enough.
Union American civilian liberties asked the government to stop holding back anyone who might risk being held.
“The action by Biden administration is a welcome step in the right direction,” said Eunice Cho, a senior staff lawyer with the organization.
Under Obama, the ice adopted a policy in August 2016 that pregnant migrants will be considered eligible for release because their cases run through the immigration court.
President Donald Trump ended the alleged release policy, part of the enforcement of his government immigration increased, including anyone’s arrest without the legal residency regardless of whether they had committed other violations.
The number of pregnant women held with ice increased from 1,380 in 2016 to 2,098, according to the Government Accountability Office.
ICE is required by law to hold some migrants, including foreign nationals that have been punished for certain crimes or terrorist activities.
The body promises that the number of pregnant women who are “very limited” detained under new policies will receive regular health care as needed and officials will be prohibited from using restraints to them except in “extraordinary circumstances.” Every child born in the US will automatically have American citizenship.
