‘There is no construction nod until you have MRF’

PANAJI: The Bombay High Court in Goa on Wednesday holds 15 Panchayats from issuing construction licenses until they build material recovery facilities (MRF) and make it function.
“This will be the responsibility of the Director of Panchayats to take strict action against Panchayats and the carrier of their office,” the division bench consisting of Judge Sadhana Jadhav and Manish Pitale.
The court passed the instructions after the report submitted by the management of cave waste specifically stated that 15 Panchayats village had failed to regulate the MRF and did not have temporary facilities for waste collection and storage.
This is a pancidayata gaondongrim, assolda, xeldem, naqueri-correct, morpila, calm, tivrem-orgao, curti-khandlepar, shiroda, cundaim, chinchinim-dussa, sarzora, and raia.
The High Court also directs that a fine that is not paid from RS 5,000 each by nine Panchayats paid within four weeks personally by Sarpanches of Kalem, Netolim, Rivona, Cana-Benaulim, Louletim, Carmona, Sao Jose de Areal, Navelim and Colva .
The fine was worn through the order on February 10, 2021, because it failed to comply with direction instructions to regulate the MRF and composting facilities.
“This is repeated that if it is found that the Sarpancha is not personally responsible for non-compliance, the appropriate order can be forwarded to allow the sarpanches to restore the amount of Panchayat funds,” said the High Court.
In the case of nerul, the MRF has been built and made functional, but there is a representation received from the villagers about the Nerul objection to be established close to the school.
“It seems that the objections gathered by the villagers of Nerul have been considered and the GWMC has reported that the MRF in terms of this court order From issuing construction licenses standing emptied, “the High Court stated.
The court was told that Panchayats Village Amona and Arambol had established MRF and made it functional, and directed the corporation to carry out MRF inspections and place reports.
The CCP proposes Affidavit which states that it has fulfilled the requirements of the Country Polution Country Control Board.
The court asked 13 city councils to submit a written statement about compliance within three weeks.
A resident of Sancoale has increased certain issues regarding the illegality in the construction of the MRF by Panchayat Sancoale Village and the High Court has given Panchayat the opportunity to respond.
