New Delhi: Delhi police have told court here that there is no evidence that can be collected so far to confirm whether the 9-year-old girl was raped before allegedly killed near the Delhi Cantonment in Southwest Delhi this month.
Investigation officer (IO) of the case told the court that the disclosure statement from the four defendants had revealed that two of them – Radhey Shyam, a 55-year-old crematorium priest, and that Kuldeep Singh employees – had been raped and killed little victims.
The rest of accusing people – Salim Ahmad and Laxmi Narayan, both employees in the crematorium – have helped them try to cremate a minor who died, IO said to the court.
“IO further recognizes that there is no statement about eyewitnesses or other evidence, including medical or scientific can be collected so far to confirm whether the child of the victim was raped or not.
He then has directed that at this stage, he cannot convincingly say whether the victim’s child Raped or not, “The court recorded in the order passed on August 12.
Statement of disclosure of people accused of before the police, unless supported by other evidence, cannot be accepted under the law.
Ashutosh Kumar’s Special Judge, Meanwhile, was awarded Rs 2.5 (RPT) 2.5 lakh as “temporary assistance” to the mother’s mother for losing her daughter’s life.
The court, however, did not provide further temporary assistance about the additional victim rape, given the submission of IO and “given the fact that the investigation body itself was not sure whether the victim was raped or not, Qua compensation while the same was not allowed at this stage.” The judge gave Freedom to the parties concerned to move fresh applications about compensation for rape, if the investigation body collects further material or comes to the conclusion that the victim’s child was raped.
A per government scheme, maximum compensation given if the loss of life is Rs 10 Lakh.
The court gave 25 percent of the amount of compensation as a temporary assistance.
The court, meanwhile, sent the four accusations, all of which were known as the girl’s mother, to hold 14 days of judicial.
According to FIR, the little girl was raped, killed and then cremated without the approval of her parents.
This case was recently transferred to the Branch of Delhi police crime.
