Bengaluru: Karnataka HC has said that the trial of a woman, who was accused of being together in the case of illegal assets, will continue even after the death of her husband, the main perpetrators, and added, “the reduction will not destroy the abetment”, reports P Vasantha Kumar.
“The death of the husband during the trial before the alleged framed will not cause the closure of the trial against co-accused (wife), which has been accused of reducing under the 109 IPC section,” observations of justice.
The CBI has registered the case of illegal wealth to M Selvakumar, which is the deputy director (research), training center, the central coffee research institute, coffee research station, Balehonnur, Chikkamagaluru Regency.
The agency has named his wife VM Saraswathi in FIR because it was accused of being together because of a lot of moving and not moving in his name.
This case refers to his post from January 2005 from March 2013.
Selvakumar died on March 29, 2017, before the allegations were framed.
On the land that the main violation of the perpetrators had subsided, he had searched out of this case.
Refusing the challenge for the continuation of the trial against Saraswathi, the High Court judge said the trial would continue before the Criminal Court.
The judge canceled the part of the command delivered by a special court for the CBI case, Bengaluru City, directed the investigation body to register a violation that could be punished under Section 13 (1) (e) Read with Section 13 (2) Prevention of the 1988 Corruption Act, fight it.
Special courts have forbidden to pursue cases of deprivation of them.
Saraswathi submitted an application before a special judge looking for discharge in this case.
On June 6, 2018, a special judge rejected the application.
Both Saraswathi and CBI challenged a special court order.
Saraswathi argues that if the act of conspiring itself cannot be proven, the question to continue the trial will result in a miscarriage of justice.
P Prasanna Kumar, a special public prosecutor for the CBI, argues that the sequence of special trial was wrong and the CBI was harmed by imposing charges of reduction.
