The tower, consisting of more than 900 flats, was declared illegal by the High Court of Allahabad in 2017.

Senior Advocate Jayant Bhushan, appeared for Rwa, told the bench that there was a clear collusion between the Noida Authority and the builder in allowing illegal construction.

He said that the “Monstrous” building was built blocking light, air circulation for residents in adjacent towers and construction was carried out in their common park area for all flat owners.
Bhushan said fake documents were placed before the HC and both authorities and Builders Noida continued to change their stands according to convenience.
Advocate Gaurav Agrawal, who helped the court as Amicus Curiae, said the demolition of the two towers could be a very difficult task and it could also disturb the adjacent building.
He said it would also be difficult for home buyers to get return on their investment from Supertech and begged that all options were explored to get out of a complicated situation.
“Bringing buildings will become a disaster for buildings and environments that are side by side.
Demolition must be carried out with bricks that are impossible,” Agrawal said.
He suggested that the affected flat owner be compensated and they can also be shifted to other housing projects.
But the bench said it would be difficult because the agreement of all 650 flat owners would be needed.
The trial remained unconvincing and will continue on Wednesday when Supertech’s advice will be against the accusation leveled by Rwa.
